SHE'S THE ASSISTANT VICE PRESIDENT AND OVER PUBLIC SECTOR PRACTICE, AND ALSO THE ACCOUNT MANAGER FOR NUMEROUS MUNICIPALITIES FOR COOKSEY COMMUNICATION, INCLUDING THE TOWN OF SUNNYVALE. SHE IS THE FORMER COMMUNICATIONS DIRECTOR FOR THE CITY OF GARLAND FOR A VERY LONG TIME, AND WE'RE BLESSED TO HAVE HER SKILLS AND EXPERTISE WORKING WITH US AND THE REST OF THE COOKSEY TEAM.

SO SHE IS HERE TO PRESENT, I BELIEVE THIS IS THE FIFTH COMMUNICATIONS AWARD WE'VE WON SINCE WE'VE CONTRACTED WITH COOKSEY TO HELP MANAGE AND IMPLEMENT OUR COMMUNICATIONS PLAN.

ESTABLISHING AN INTERLOCAL AGREEMENT FOR EMERGENCY MEDICAL SERVICES DATA BY, BY, AND BETWEEN DALLAS COUNTY ON BEHALF OF DALLAS COUNTY HEALTH AND HUMAN SERVICES AND THE TOWN OF SUNNYVALE, TEXAS, ON BEHALF OF THE SUNNYVALE FIRE DEPARTMENT CHIEF KYLE.

GOOD EVENING. MAYOR, COUNCIL, TOWN MANAGER AND STAFF.

YES. WE'D LIKE TO PROPOSE RESOLUTION 2020 506.

THIS IS BEING BROUGHT ON LARGELY DUE TO SENATE BILL 1319, WHICH CREATED A MANDATORY REPORTING OF CONTROLLED SUBSTANCES TO DALLAS COUNTY HEALTH OR TO YOUR OWN LOCAL HEALTH AUTHORITY.

IT REQUIRES EMS AGENCIES TO REPORT ALL OVERDOSES, NOT JUST OPIOID, BUT ANY OVERDOSE TO THEIR LOCAL HEALTH AUTHORITY.

ONCE THAT LOCAL HEALTH AUTHORITY HAS ESTABLISHED SOME TYPE OF MAPPING CAPABILITY, JUST TO GIVE A LITTLE BIT OF A TIMELINE. SEPTEMBER 2023 IS WHEN THE SENATE BILL WENT INTO EFFECT, BUT AT THAT POINT, DALLAS COUNTY WAS NOT READY YET TO START RECEIVING DATA.

WE WERE NOTIFIED THIS PAST NOVEMBER THAT THEY ARE NOW READY TO RECEIVE DATA.

THEY HAD BEEN DOING A TRIAL WITH DALLAS FIRE, AND THEY FELT LIKE THEY WERE CONFIDENT NOW TO START RECEIVING DATA FROM ALL THE EMS AGENCIES IN DALLAS COUNTY. I THEN REACHED OUT TO THEM TO MAKE THAT ARRANGEMENT, SEE WHAT EXACTLY THEY NEEDED, AND THEY ASKED, WELL, CAN WE MEET WITH YOU ABOUT SOMETHING ELSE IN THE PROCESS? AND I SAID, OKAY. SO IN DECEMBER, I HAD A MEETING WITH THEM AND THEY SAID WE WANTED TO.

THEY'RE ALSO WANTING TO SEE ABOUT GETTING OTHER DATA FOR PUBLIC HEALTH THAT WILL HELP THEM RECOGNIZE PUBLIC HEALTH.

POSSIBLE PANDEMICS OR OTHER THINGS BEFORE EARLY OF THEIR OCCURRING.

AND SO I SAID, OKAY, WELL, DO YOU HAVE AN ILA WRITTEN UP FOR THAT, THAT I CAN TAKE TO MY TOWN? AND THEY SAID, WE'RE WORKING ON IT. I SAID, OKAY.

SO IN JANUARY, THEY THEN CAME AND THEY MET WITH ALL OF THE CHIEFS OF DALLAS COUNTY AND MADE THE SAME REQUEST FROM ALL DEPARTMENTS THAT THEY WOULD LIKE TO RECEIVE NOT ONLY THE MANDATED DATA INCENTIVE BILL 1319, BUT ALSO OTHER DATA THAT WOULD HELP THEM IN BEING ABLE TO RECOGNIZE ANY PUBLIC HEALTH EMERGENCIES OR PUBLIC HEALTH CONCERNS.

HOPEFULLY EARLY IN THEIR OCCURRENCE SO THAT THEY CAN TAKE ACTION TO PREVENT THEM FROM BECOMING MORE WIDESPREAD.

SOME OF THE KEY POINTS OF IT IS THIS ILA NOT ONLY WILL MAKE US COMPLIANT WITH THE SENATE BILL BUT IT ALSO JUST HELPS US SUPPORT DALLAS COUNTY IN THEIR EFFORT TO RECOGNIZE PUBLIC HEALTH CONCERNS AND TO BE ABLE TO HOPEFULLY MEDIATE BEFORE THEY BECOME MORE WIDESPREAD.

THE DATA TRANSFER WOULD BE DONE BY PROGRAMING WITHIN OUR CURRENT ELECTRONIC PATIENT SYSTEM SOFTWARE.

I ACTUALLY WOULD DO THE PROGRAMING. SO THERE'S NO EXTRA SOFTWARE NEEDED AND NO ADDITIONAL COST TO US TO PROVIDE THIS DATA.

THE DATA WILL BE ENCRYPTED AND IT WILL BE DE-IDENTIFIED.

IT WON'T HAVE LIKE PATIENT NAMES OR THAT KIND OF STUFF.

AND IT'LL ONLY BE USED AS PERMITTED BY LAW AND THE ILA.

AND THEN THE REPORTS THAT ARE GENERATED, BECAUSE THEY WILL BE CREATED INTERNALLY AND WITHIN OUR SOFTWARE BY US, IT WILL ALLOW US TO MAKE CHANGES AS NEEDED FOR ANY FUTURE YOU KNOW, PANDEMIC EPISODES, SOMETHING NEW COME ABOUT.

THEN WE'LL HAVE THE ABILITY TO MAKE THAT CHANGE, TO PROVIDE THE DATA SO THAT DALLAS COUNTY CAN TRY TO RECOGNIZE WHAT MAY BE HAPPENING AND HOPEFULLY TAKE SWIFT ACTION TO MEDIATE. SO THAT'S HOW THE RESOLUTION CAME ABOUT AND WHAT IT WOULD ENTAIL AND WHY.

WE'RE REQUESTING YOUR PASSING OF THE RESOLUTION AND AGREEMENT WITH THE ILA.

DESIGN OF EROSION CONTROL MEASURES TO STABILIZE STREAM EROSION ON TRIBUTARY SIX IN THE FALLS.

ADDITION. THANK YOU. MAYOR, MAYOR AND COUNCIL MATT HOLZAPFEL, TOWN ENGINEER.

BEFORE YOU IS A CONTRACT FOR GRANTHAM AND ASSOCIATES FOR YOUR CONSIDERATION IN THE AMOUNT OF $235,820.

AND THIS IS PRIMARILY FOR FLOODPLAIN MODELING AND ENGINEERING ASSOCIATED WITH FIXING THE EROSION THAT WE'RE SEEING CURRENTLY ON WHAT THEY CALL TRIBUTARY SIX. THAT'S AFFECTING THE TRAILS. THE FALLS ADDITION TRAIL.

THE TO GIVE A LITTLE BIT OF BACKGROUND, THE THE FALLS ADDITION WAS BUILT IN TWO PHASES.

THE FIRST PHASE OF INFRASTRUCTURE WAS COMPLETED IN JUNE OF 2002, AND THEN THE SECOND PHASE WAS COMPLETED IN THE SUMMER OF 2016. SO THE SECOND PHASE WAS QUITE A BIT AFTER THE FIRST PHASE.

THERE IS A TRAIL THAT WAS BUILT WITH THOSE PHASES THAT IS IN AN ENCORE EASEMENT THAT IS ON THE EAST OR, EXCUSE ME, THE WEST SIDE OF THAT SUBDIVISION RUNNING NORTH TO SOUTH.

AND IT ROUGHLY PARALLELS WHAT IS KNOWN AS TRIBUTARY SIX OF LONG CREEK.

TRIBUTARY SIX OF LONG CREEK IS A FEMA MAPPED FLOODPLAIN TRIBUTARY, SO IT IS ON OFFICIAL FEMA MAPS.

IT HAS BEEN EXPERIENCING BECAUSE OF CHANGES IN THE WATERSHED UPSTREAM DEVELOPMENT AND THINGS OF THAT NATURE THAT THAT TRIBUTARY IS EXPERIENCING WHAT THEY CALL HEAD CUTTING, GULLY EROSION.

AND IT'S BASICALLY WHERE THE ENERGY IN THE WATER IS STARTING TO FORM A MUCH DEEPER GULLY, AND IT'S SLOWLY MOVING ITS WAY UPSTREAM.

RACHEL, I DON'T KNOW IF YOU COULD PULL UP. I GUESS WE DON'T HAVE A WAY OF DISPLAYING ANYTHING RIGHT NOW.

WELL, THERE ARE SOME EXHIBITS THAT ARE IN YOUR PACKET TOWARDS THE END OF YOUR PACKET FOR THIS ITEM.

BUT BASICALLY, IF YOU LOOK AT OLD AERIAL PHOTOGRAPHS, YOU CAN SEE THE STARTING OF THAT GULLY.

AND OVER THE LAST COUPLE OF YEARS, IT'S PROGRESSED VERY RAPIDLY UPSTREAM.

WHEN I FIRST GOT HERE IN OCTOBER OF 23, IT WAS ONE OF THE FIRST THINGS THAT JEFF BROUGHT ME OUT TO TO LOOK AT THAT PROBLEM.

WE STARTED MONITORING IT AT THAT POINT IN THE SPRING OF 2024.

THE EROSION THAT GOT GOTTEN CLOSE ENOUGH TO THE TRAIL THAT THE TOWN TOOK ACTION TO CLOSE THE TRAIL IN ORDER TO SAFEGUARD THE TRAIL USERS, TO MAKE SURE THEY WEREN'T USING THE TRAIL NEAR THAT VERY STEEP AND DEEP DROP OFF THAT WAS RIGHT ADJACENT TO THE TRAIL.

WE STARTED NEGOTIATIONS RELATIONS WITH THE HOA AT THAT TIME, WHO WHICH WAS THEN CURRENTLY OPERATED BY TED LYONS, WHO WAS STILL IN THE MANAGEMENT OF THE DEVELOPER AT THAT TIME IN 2024, A TRANSITION FROM THE HOA BEING RUN AND MANAGED BY THE DEVELOPER TO AN ELECTED BOARD OF THE RESIDENTS OF THE FALLS EDITION.

WE STARTED AGAIN NEGOTIATING WITH THEM. IT QUICKLY BECAME APPARENT THEY HAD NEITHER THE TECHNICAL EXPERTISE NOR THE FINANCIAL CAPACITY TO AFFECT DESIGN AND BUILD EROSION CONTROL THAT WOULD REPAIR THE DAMAGE TO THAT STREAM, STABILIZE IT, AND PUT THE TRAIL BACK IN OPERATION. THERE WAS A NUMBER OF CONVERSATIONS WITH COUNCIL AND STAFF.

DURING THAT TIME, FOLLOWING THOSE DISCUSSIONS WITH THE HOA AND COUNCIL MADE THE DECISION BECAUSE IT WAS A MAJOR TRAIL IN THE TOWN'S TRAIL NETWORK. THAT THE TOWN WOULD TAKE ON THE RESPONSIBILITY OF DESIGNING A REPAIR.

AND BUILDING THE FIX TO THAT EROSION AND PUTTING THE TRAIL BACK IN SERVICE.

SO TOWN STAFF THEN STARTED NEGOTIATING WITH GRANTHAM AND ASSOCIATES TO DEVELOPING A DETAILED SCOPE OF SERVICES, WHICH IS IN YOUR PACKET. IT'S AN EIGHT PAGE SCOPE OF SERVICES THAT STARTS ON PAGE 81.

TO BASICALLY DO THE NECESSARY FEMA FLOODPLAIN MODELING AND COME UP WITH DESIGN ALTERNATIVES TO REPAIR THE EROSION, STABILIZE THE CREEK, AND TO REPAIR THE TRAIL.

BECAUSE IT IS A FEMA MAPPED FLOODPLAIN. THERE IS TECHNICAL REQUIREMENTS THAT ARE REQUIRED BY FEMA THAT WE MUST FOLLOW THE FLOODPLAIN.

MODELING HAS SOME VERY COSTLY TECHNICAL REQUIREMENTS.

IT'S KIND OF A TWO STEP PROCESS. WE HAVE TO DEVELOP A MODEL AND COME UP WITH PLANS TO STABILIZE THE CREEK.

THOSE MODELS THEN HAVE TO BE SUBMITTED TO FEMA FOR THEIR REVIEW AND APPROVAL, AND ONCE THEY REVIEW IT AND GIVE APPROVAL, THEY ISSUE WHAT THEY CALL A CONDITIONAL LETTER OF MAP REVISION, BASICALLY MEANING THIS WHAT YOU'VE PROPOSED MEETS OUR TECHNICAL REQUIREMENTS. IT BASICALLY GIVES US PERMISSION TO GO AHEAD AND BUILD THOSE REQUIREMENTS OR THOSE PROPOSED PLANS.

ONCE WE'RE DONE WITH THE WORK, THEN WE HAVE TO SUBMIT A FORMAL LETTER OF MAP REVISION.

AND AGAIN, WE HAVE TO TAKE BASICALLY AS BUILT PLANS.

WE HAVE TO DOCUMENT WHAT WAS BUILT, CONFIRM THAT IT MET THE ORIGINAL SUBMISSION, AND RESUBMIT THAT TO FEMA.
