DIMENSIONAL REGULATIONS. CHART OF SINGLE FAMILY RESIDENTIAL DISTRICT TWO OR SF TWO ZONING DISTRICT AS IT RELATES TO THE REQUIRED FRONT YARD SETBACK ON THE PROPERTY LOCATED AT 474 NORTH COLLINS ROAD, WHICH IS ZONED SF TWO.

SO ON YOUR SLIDE IN FRONT OF YOU ON THE PRESENTATION, ON THE RIGHT SIDE IS THE AERIAL PHOTO SHOWING THE PROPERTY OR THE PROPERTY KIND OF CIRCLE, OR SHOWING IN THE RECTANGLE SIGN FOR 74 NORTH COLLINS ROAD IS ZONED SF TWO, ABOUT ROUGHLY 1.33 ACRES IN SIZE.

THE REQUEST, AS I MENTIONED FROM THE AGENDA CAPTION, IS FOR A FRONT YARD SETBACK VARIANCE UNDER SF TWO ZONING.

THE TABLE SHOWS YOU WHAT THE REQUIRED SETBACKS ARE WITHIN SF TWO.

SO MINIMUM SETBACK REQUIREMENTS FOR SF2 ZONING IS FOR THE FRONT YARD 70FT.

SIDE YARD IS 30FT. AND BACKYARD OR REAR YARD SETBACK IS 80FT.

GOING TO THE NEXT SLIDE, I'M GOING TO TALK BRIEFLY ABOUT THE PROJECT THROUGH THIS TWO GRAPHICS THAT THE APPLICANT HAS PROVIDED.

KEVIN POINTS, WHO IS THE CURRENT OWNER AND RESIDENT ON THIS PROPERTY.

HE AND HIS FAMILY PURCHASED THIS PROPERTY IN 20.

DURING 2018, THERE WAS AN EXISTING HOUSE OR A STRUCTURE OR SINGLE FAMILY DWELLING ON THIS ON THIS LOT.

HOWEVER, WHEN THEY TRY TO RENOVATE OR THEIR PLAN ORIGINALLY WAS TO RENOVATE AND REPURPOSE THE HOUSE SO THAT THEY CAN LIVE THERE WITH THEIR FAMILY.

HOWEVER, WHEN THE ENGINEER FOUND SOME CERTAIN FOUNDATION ISSUES AND OTHER STRUCTURAL ISSUES WITH THE EXISTING RESIDENCE, THEY WERE ADVISED THAT IT'S BETTER TO DEMOLISH THAT STRUCTURE AND BUILD A NEW ONE, BECAUSE THE EXPENSE OF DOING ALL THOSE REPAIRS AND RENOVATIONS WERE GOING TO BE NOT PRACTICAL. RATHER, IT WAS EASIER TO BUILD A NEW HOUSE.

SO THE PROPOSED FLOOR PLAN THAT THE APPLICANT HAS PROVIDED, AS WELL AS ON THIS SCREEN, YOU CAN SEE THE SITE LAYOUT KIND OF SHOWING THE BUILDING OUTLINE ON THE LEFT SIDE OF YOUR SCREEN. ON THE RIGHT SIDE IS THE FORM SURVEY OR THE SURVEY SHOWING THE PROPERTY, AS WELL AS THE DRIVE APPROACH FROM COLLINS ROAD.

SO I WANTED TO POINT OUT ON THE LEFT SIDE OF YOUR SCREEN A BEAUTIFUL FEATURE OF THIS EXISTING PROPERTY, WHICH IS A REALLY VALUABLE ASSET TO SUNNYVALE FOR MANY OF THE EXISTING RESIDENTIAL LOTS, IS IT'S A BEAUTIFUL WOODED LOT.

SO IT HAS MATURE LIVE OAK AND OTHER CANOPY TYPE TREES.

THE THREE THAT I KIND OF THE CIRCLES THAT I HIGHLIGHTED IN GREEN, THOSE ARE THE THREE MATURE TREES IN THE BACK OF THE HOUSE OR THE WHERE THE NEW HOUSE WILL SIT THERE. AS YOU CAN SEE FROM THE LEFT GRAPHIC, IT'S PRETTY CLOSE TO THE STRUCTURE.

IF YOU WERE TO MEET THE 70 FOOT SETBACK. NOW ON THE RIGHT SIDE OF YOUR SCREEN, YOU CAN SEE THAT LINE THAT'S DRAWN.

SO IT KIND OF SHOWS YOU IN COMPARISON THAT ONE ELEMENT OF THE HOUSE, THAT GRAY SHADED KIND OF ROOM, IF YOU WILL, THAT'S GOING TO JUT OUT OF THE REQUIRED 70 FOOT FRONT YARD SETBACK.

AND THE VARIANCE IS REQUESTING IS FOR 61.5FT OF FRONT YARD SETBACK.

SO THE REASON THE APPLICANT IS REQUESTING THIS SETBACK VARIANCE IS HE WANTS TO PUSH THE HOUSE A LITTLE BIT TOWARDS THE FRONT AND NOT THE WHOLE HOUSE, JUST THAT ONE ROOM SO THAT THE TREES AT THE BACK CAN BE SAVED.

BECAUSE IF THEY ARE SO CLOSE TO THE FOUNDATION, AS YOU KNOW, FOR A DEVELOPED, MATURE SHADE TREE, THEIR ROOT STRUCTURES ARE ENORMOUS AND IT CAN CAUSE FOUNDATION PROBLEMS. AND ACTUALLY DURING CONSTRUCTION, THE DAMAGE CAN BE SEVERE WHERE THEY CAN LOSE THE TREES.

SO EVEN THOUGH THERE AREN'T ANY, AS I MENTIONED IN MY STAFF REPORT.

SO EVEN THOUGH THERE AREN'T ANY PHYSICAL OR GEOLOGICAL HARDSHIP WITH THIS PROPERTY AS SUCH TO SAVE THE TREES, THEY ARE TRYING TO ACHIEVE THE GOALS AND OBJECTIVES OF ANOTHER TOWN CODE, WHICH IS OUR TREE PRESERVATION ORDINANCE BECAUSE WE DO REQUIRE TREE PRESERVATION.

WE ARE. ONE OF OUR STATED GOALS FOR SUNNYVALE IS THAT WE WANT TO PRESERVE OUR MATURE CANOPY TREES FOR SEVERAL REASONS.

SO THAT'S IN A NUTSHELL WHY THE VARIANCE IS BEING REQUESTED FOR THE FRONT YARD SETBACK TO FIT THE FLOOR PLAN WHERE THIS ONE PORTION OF THE HOUSE, THE FRONT FACADE IS GOING TO GO WITHIN THE REQUIRED 70 FOOT SETBACK.

YOU CAN SEE THE ONES IN THE BACK YARD A LITTLE BIT FARTHER BACK.

AND THEN ON THE RIGHT SIDE OF YOUR SCREEN, THERE'S THE IMAGE FROM GOOGLE, FROM THE PREVIOUS WHEN THE PREVIOUS HOUSE WAS THERE WITH THAT EXISTING DRIVEWAY.

SO THAT'S PRETTY MUCH MY PRESENTATION FOR YOU TONIGHT.

IT'S A VERY STRAIGHTFORWARD APPLICATION. STAFF RECOMMENDS APPROVAL OF THE VARIANCE REQUEST FOR THE REASONS I EXPLAINED IN THE STAFF REPORT.

ALSO, SINCE WE SEND THE AS REQUIRED BY STATE LAW AND OUR ZONING ORDINANCE, WE SEND NOTICES OUT WITHIN 200FT OF THE SUBJECT PROPERTY.

AND I HAVE RECEIVED FOUR LETTERS IN FAVOR OF THIS VARIANCE REQUEST AND A PHONE CALL.

ALSO THE TWO THAT ARE IN YOUR PACKET. I RECEIVED THEM BEFORE THE PACKET WAS POSTED TO.

I RECEIVED AFTER, AND THEY WERE ALL FROM HOMEOWNERS OR RESIDENTS ALONG NORTH COLLINS THAT ARE PRETTY CLOSE TO THIS PROPERTY.

SO THE NEIGHBORS ARE AMENABLE TO THIS VARIANCE REQUEST.

NO ONE HAD ANY ISSUES OR I HAVEN'T RECEIVED ANY RESPONSE AGAINST THIS APPLICATION.
